Ownership and Age/Legal Restrictions

1. This Website is owned and operated by Meta PsycKicks, LLC. By accessing Meta PsycKicks, LLC’s website, User hereby affirms that they have read, understand, and agree to be bound by the following Terms. The following Terms set forth the terms and conditions under which the User may purchase and/or receive any service Meta PsycKicks, LLC may offer.

2. In order to receive any products or services, User must be 18 years of age, or of the legal age of majority in their jurisdiction, and hold the legal authority, right, and freedom to enter into these Terms as a legally-binding agreement. If User is outside of the above legal boundaries and/or legal jurisdiction, User may not receive or purchase any of the products or services Meta PsycKicks, LLC offers.

3. When buying a product(s) or service(s) including a reading or any variation of a reading, the User agrees to the following (i) responsibility for reading the full products or services description and information before making a commitment to purchase the associated product(s) or service(s): (ii) the User enters into a legally-binding contract to purchase said product(s) or service(s) when the User completes the check-out payment process.

The prices Meta PsycKicks, LLC charges for its products and services are listed on their website. Meta PsycKicks, LLC reserves the right to change its prices for any and all products or services displayed at any time and to correct any and all pricing errors that may inadvertently occur. Additional information regarding pricing details and sales tax is available on each product or services payment page.

The fee for any and all products or services and any other charges the User may incur in connection with the use or purchase of Meta PsycKicks, LLC’s products or services, such as taxes, travel fees, and possible transaction fees will be charged to the User’s provided payment method.

All purchases of any and all products or services, including readings or any variation of readings, are nonrefundable. Meta PsycKicks, LLC reserves the right to refuse and refund any User at any time and for any reason; however, commit to fulfilling Users’ order(s) in the descriptive way outlined within the purchase page.

If User wishes to cancel a reading, or any variation of a reading, User must do so within forty-eight (48) hours of the scheduled reading. No refunds will be given regarding readings or any variation of a reading, after they have occurred. No refunds for pre-recorded videos. If a User cancels a reading or variation of a reading appointment, the User will be afforded an opportunity to reschedule no more than twice, and said appointment must be rescheduled within six (6) months of the original appointment date A credit will remain on file for six months. Failure to reschedule an appointment within this timeframe shall result in forfeiture of the User’s credit, which will be retained by Meta PsycKicks, LLC.  All sales of all services are final. No exceptions.

If User misses their scheduled appointment or timeframe by more than fifteen (15) minutes, Meta PsycKicks, LLC reserves the right to deny the User further opportunity to reschedule their purchased service and will consider the User’s appointment/service forfeited. No refunds or credits will be given for forfeited appointments regarding any readings or variations of  readings.

Meta PsycKicks, LLC reserves the right to change, stop, and/or limit any and all products and services, without prior notice. Meta PsycKicks, LLC may permanently or temporarily terminate or suspend access to any and all products or services without prior notice and without liability for any reason, or no reason at all.

Rights and Terms to Meta PsycKick’s Content and User Uploaded Content

4.  Any and all product(s) and service(s) and materials therein or transferred thereby, including without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, trademarks, service marks, copyrights, photographs, audio, videos, music and all intellectual Property Rights related thereto, are the exclusive property of Meta PsycKicks, LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and User agrees not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works thereof.

5. The User recognizes and agrees that by uploading any content (including but not limited to designs, images, animations, videos, audio, files, fonts, logos, illustrations, compositions, artworks, interfaces, text, and literary works) through any means to Meta PsycKicks, LLC’s website or related media, that the User owns all relevant rights or received the appropriate license to upload/transfer/send the content. The User agrees and consents that the uploaded/transferred content may be publicly displayed on Meta PsycKicks, LLC’s website and/or any other associated media.

Liability

6. User agrees to indemnify and hold Meta PsycKicks, LLC harmless from any demands, liability, claims, loss, or expenses (including attorneys’ fees) made against it by any third party due to, or arising out of, or in connection with User’s use of the website or any and all services offered on Meta PsycKicks, LLC’s website.

To the maximum extent of the law, Meta PsycKicks, LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of any and all content; (ii) personal injury or property damage of any nature whatsoever, resulting from the User’s access and/or associated parties to or use of Meta PsycKicks, LLC’s service(s); and (iii) any unauthorized access to or use of Meta PsycKicks, LLC’s secure servers and/or any and all personal information stored therein.

Right to Change Terms

7. Meta PsycKicks, LLC reserves the right to change or modify these Terms at its discretion. The User’s continued use of Meta PsycKicks, LLC’s website or service(s) constitutes the User’s acceptance of the new Terms. If the User does not agree to any of the new Terms set forth, User should stop use and discontinue accessing Meta PsycKicks, LLC’s website or service(s)

8. These Terms, the rights and remedies provided herein, and any and all claims and disputes related hereto and/or to the services, shall be governed by, constructed under, and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United States of America/Ohio, without respect to its conflict of laws and principles. Any and all such claims and disputes shall be brought in, and the User, and any associated Users, hereby consent to any and all conflicts and/or disputes being decided exclusively by a court of competent jurisdiction located in Lake County, Ohio. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

Personal Information Corrections

9. If User or any associated party would like to access, correct, amend, or delete any personal information, Meta PsycKicks, LLC may have regarding User and/or any associated parties, they are invited to contact Meta PsycKicks, LLC at metapsyckicks@gmail.com.

Meta PsycKicks, LLC’s Scheduling Policy:

User’s Agreement to Scheduling; Terms and Conditions

By scheduling any service(s) regarding readings or any variation of a reading with Meta PsycKicks, LLC, User hereby agrees to Meta PsycKicks, LLC’s Scheduling and Cancellation Policy outlined below. Please read the policy carefully and in its entirety.

Note: All sessions are being conducted virtually at this time via Zoom, unless otherwise specified.

Scheduling Confirmation

Once the User has scheduled and paid for a reading or any variation of a reading, User will receive an automatic email confirming their appointment with the details of the upcoming session.

Zoom Readings and/or Variations of Readings

The User will receive an email containing the Zoom Meeting Link for their reading. Please be patient regarding this email’s arrival. If User has not received the Zoom Link email within two (2) days of scheduling the appointment, User should check their junk email folder. If it is not there, please email metapsyckicks@gmail.com.

Pre-Recorded Readings and/or Variations of Readings

After receiving their order, the User will receive an automated confirmation email. Once the order is placed, Meta PsycKicks, LLC will record the reading video and upload it as a private/unlisted video. The User will then receive a separate email of the private/unlisted video URL of their pre-recorded video. This can take up to ten (10) business days after the order confirmation.  If User has not received your pre-recorded video after ten (10) business days upon ordering, User should check their junk email folder. If it is not there, please email metapsyckicks@gmail.com.

Gift Certificates & Policy

By purchasing, using, or accepting one of Meta PsycKicks, LLC’s gift certificates, User hereby agrees to Meta PsycKicks, LLC’s Gift Certificate Policy and Terms of Service as outlined herein. Please read the policy carefully and in its entirety.

Upon purchase of a Meta PsycKicks, LLC gift certificate, said gift certificate will be sent to the indicated/provided email address of the intended User immediately after the purchase is completed. The purchaser is/are required to provide a correct and valid email address. Meta PsycKicks, LLC is not responsible for the correction or reimbursement of gift certificates not received due to incorrect recipient email address(es).

Meta PsycKicks, LLC’s gift certificate(s) will include a code that can be entered as a payment method for the reading indicated at purchase. This excludes pre-recorded videos.

The Gift Certificate(s)’ code will be included in the email sent after purchase to the provided email address. Your Meta PsycKicks, LLC gift certificate(s) cannot be exchanged or redeemed for cash. Promotional offers and discounts cannot be applied to the purchase of a Meta PsycKicks, LLC gift certificate.

Meta PsycKicks, LLC gift certificates can be used until the balance(s) reaches zero. Meta PsycKicks, LLC’s gift certificates do not hold any expiration dates. Meta PsycKicks, LLC gift certificates may not be copied or resold. Meta PsycKicks, LLC reserves the right to void any gift certificate without refund or notice if there is any suspicion of fraudulent activity or otherwise in violation of our Terms of Service.

No refunds will be given after the Meta PsycKicks, LLC  gift certificate is received. No Exceptions.

Any Meta PsycKicks, LLC gift certificate that is lost or stolen cannot be replaced. No Exceptions.

Preparing for your Reading or Variation of a Reading

Please make sure you are in a place where you will not be distracted or disturbed for the duration of your reading.

Be sure you have a good internet connection prior to your reading appointment. Meta PsycKicks, LLC will not be able to reschedule your reading due to technical difficulties caused by any participant’s (i.e. User) technical difficulties.

Cancellations

If User wishes to cancel a reading, or any variation of a reading, User must do so within forty-eight (48) hours of the scheduled reading. Arriving Late for User Scheduled Appointments

If User arrives late to the appointment, no additional time will be added to the scheduled time frame and the reading will run up to the originally-scheduled end time.

Conduct

The User, and any associated participant(s) of readings or variations of readings, agree not to reproduce, sell, duplicate, or exploit any portion of the service(s) provided without written consent from Meta PsycKicks, LLC. The User, and any associated participant(s), agree to be respectful of Spirit and the spirit world, including any and all associated participants of the appointment.

Meta PsycKicks, LLC reserves the right to refuse service or terminate an appointment for any reason.

Meta PsycKicks reserves the right to reschedule your previously-scheduled appointment via email or phone call due to illness or family emergencies.

Disclaimer

By purchasing and scheduling any and all products and services Meta PsycKicks, LLC offers, User acknowledges that Meta PsycKicks, LLC is in no way represents itself or its service providers to be medical professionals. Any guidance suggestion(s) User chooses to act upon is doing so of their own volition. Meta PsycKicks, LLC is not responsible for User’s choices or actions taken beyond or outside the services Meta PsycKicks, LLC provides. User, and any and all associated participants, fully acknowledge the products and/or services purchased and provided are enacted at the User’s and associated participants’ own risk. Meta PsycKicks, LLC is not liable for decisions made as a result of any products or services. All products and services provided are for entertainment purposes only.
